Terms of Service

1. Agreement to Terms

By accessing or using Chatity ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Chatity provides an AI-powered chatbot widget that automates client booking processes for businesses. The Service includes:

• Embeddable chat widget for your website
• AI-powered conversation handling
• Automated booking collection and notifications
• Email and Telegram notification delivery
• Dashboard for managing bookings and settings

3. Account Registration

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years of age
• Not create multiple accounts for the same business
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription Plans and Payments

4.1 Free Trial

New accounts receive a 7-day free trial. No credit card is required for the trial period.

4.2 Paid Plans

• Starter: €39/month or €390/year (100 conversations/month)
• Professional: €89/month or €890/year (1,000 conversations/month)
• Unlimited: €199/month or €1,990/year (unlimited conversations)

4.3 Billing

• All payments are processed securely through Stripe
• Subscriptions auto-renew unless cancelled
• Annual plans offer a 2-month discount (10 months price for 12 months service)
• Prices are in EUR and exclude applicable taxes

4.4 Refunds

All sales are final. Once a subscription payment has been processed, no refunds will be issued. You may cancel your subscription at any time to prevent future charges, but no refund will be provided for the current billing period.

Exception: Refunds may be considered on a case-by-case basis for technical issues that prevent you from using the service, at our sole discretion.

5. Usage Limits and Fair Use

• Conversation limits apply based on your subscription plan
• Unlimited plan is subject to fair use policy (no abuse or reselling)
• We reserve the right to throttle or suspend accounts engaging in abuse
• Booking data older than 30 days is automatically deleted

6. Acceptable Use Policy

You agree NOT to:

• Use the Service for illegal purposes
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Reverse engineer or copy our technology
• Use the Service to spam or harass others
• Impersonate another person or entity
• Collect user data without consent

7. Intellectual Property

The Service, including all software, content, and trademarks, is owned by Chatity. You retain ownership of your business data and client information.

By using the Service, you grant us permission to use your data to provide and improve the Service as described in our Privacy Policy.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with advance notice
• Make emergency updates without notice
• Modify or discontinue features with reasonable notice

9. Termination

You may cancel your subscription at any time from your dashboard. We may suspend or terminate your account for:

• Violation of these Terms
• Non-payment
• Fraudulent or illegal activity
• Abuse of the Service

Upon termination, your access will cease immediately, and your data will be deleted after 30 days.

10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Error-free or uninterrupted operation
• 100% accuracy of AI responses
• Compatibility with all websites or browsers
• Specific business results or booking rates

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

11. Indemnification

You agree to indemnify and hold Chatity harmless from any claims arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of France. Any disputes will be resolved in the courts of Nice, France.

13. Changes to Terms

We may modify these Terms at any time. Significant changes will be announced via email. Continued use of the Service after changes constitutes acceptance.
