Terms of Service

Last updated: October 15, 2026

These Terms of Service ("Terms") govern access to and use of Chatity — the AI receptionist, omnichannel inbox, online booking, mini-site and client-management software operated by MINDUNITE SAS, SIREN 990 299 414, 7 Avenue de Fabron, 06200 Nice, France ("Chatity", "we", "us"). Together with the Privacy Policy, the Data Processing Agreement (DPA) and the Subprocessors list, they form the entire agreement between you and Chatity.

In short: Chatity is a technology provider. Businesses (salons, studios, independent professionals) use it to talk to their clients and manage appointments. Chatity is not a party to any appointment or service between a business and its client. Businesses own their account data and are responsible for how they communicate with their clients; Chatity processes client data only on their behalf.

1. Who these Terms apply to

Account Owner — the business or person who creates a Chatity account and subscribes. Only authorised representatives of a business may open an account; personal or family use is not permitted. You must be at least 18 years old.

Professional / team member — a person invited by the Account Owner to use the account (staff, administrators). Team members act under the Account Owner's responsibility.

End Client — a customer of a business who books an appointment, chats, calls or otherwise interacts with the business through Chatity (website widget, mini-site, WhatsApp, Instagram, telephone). Sections 2, 11, 13 and 16 apply to End Clients. End Clients do not need an account and are not charged by Chatity.

2. Chatity is not a party to the business–client relationship

Chatity provides the technology that lets a business communicate with its clients and manage appointments. Chatity does not provide beauty, wellness or any other services, does not employ, supervise or license professionals and does not guarantee the quality, safety, legality or outcome of any service provided by a business.

Any appointment, payment, cancellation policy, complaint or dispute between an End Client and a business is exclusively between them. The business is solely responsible for complying with the laws applicable to its activity (professional licences, hygiene, consumer information, pricing, cancellation rights, invoicing).

3. Description of the service

  • AI chat assistant for websites (widget) and public mini-sites with online booking
  • Omnichannel inbox: website chat, WhatsApp (via Green API), Instagram (via Zernio), telephone voice assistant (via Twilio and ElevenLabs)
  • Calendar, team and schedule management, client records (CRM), reminders and follow-ups
  • Marketing tools (client reactivation) subject to section 8
  • Notifications by email, Telegram and push; integrations such as calendar synchronisation (Planity iCal) and payments (Stripe)

The core CRM (calendar, online booking, mini-site, client records) is provided free of charge. The AI receptionist, messaging-channel integrations and add-ons are paid features. We continuously develop the service and may add, modify or discontinue features; material removals of paid functionality are announced in advance.

4. Account, security and ownership of account data

You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account and must notify us promptly of any unauthorised use at support@chatity.io.

All data in an account (clients, bookings, conversations, settings) is treated as belonging to the Account Owner, not to individual team members. Chatity may rely on the Account Owner designation to decide who may export, transfer or delete account data and is not involved in internal disputes within a business.

5. Subscriptions, fees, trial, cancellation

Paid features are offered as monthly or yearly subscriptions. Prices are shown in the dashboard before purchase, inclusive of applicable VAT where required. New accounts may receive a free trial; unless you subscribe, paid features are simply disabled at the end of the trial — no card is required and nothing is charged automatically.

Subscriptions renew automatically for the same period until cancelled. You can cancel at any time from the dashboard; access to paid features continues until the end of the paid period and no further charge is made. Payments already made are not refunded for the current period, except as required by law (see below) or in case of a service failure attributable to Chatity.

Price changes are notified at least 30 days in advance and apply from the next renewal. If you do not accept a change, you may cancel before it takes effect.

Right of withdrawal: if you are a professional with five or fewer employees subscribing outside the scope of your main activity (Code de la consommation, art. L221-3), you benefit from a 14-day withdrawal right from the date of subscription, provided the service has not been fully performed with your prior express agreement. Contact support@chatity.io to exercise it.

Chatity is not a bank or payment institution. Payments between a business and its clients are handled by third-party payment providers under their own terms.

6. Acceptable use

  • Use the service only for your own legitimate business
  • Do not send unlawful, harassing, fraudulent or misleading messages, and do not use the service for spam
  • Do not upload content that infringes third-party rights or contains malware
  • Do not reverse engineer, scrape, resell or build a competing service from Chatity, and do not circumvent usage limits or security features
  • Do not use the service to offer illegal services or products

Fair-use limits (e.g. number of AI conversations, phone minutes, messages) are displayed in the dashboard. We may throttle, suspend or terminate accounts that abuse the service or threaten its security or other users.

7. Your clients' data — roles under the GDPR

For personal data of your clients and prospects processed through Chatity, you are the data controller and Chatity (MINDUNITE SAS) is your data processor under Article 28 GDPR. The Data Processing Agreement at chatity.io/dpa is part of these Terms and governs that processing; the current list of subprocessors is published at chatity.io/subprocessors.

You are responsible for having a lawful basis for the data you collect, for informing your clients (Chatity displays a privacy notice naming your business on your mini-site and widget) and for responding to their requests. Chatity provides tools to export, correct and delete a client's data and keeps an audit trail of actions performed on client data.

8. Communications with your clients: transactional vs. marketing

Transactional messages (booking confirmations, reminders, cancellations, answers to a client's request) are sent as part of the service requested by the client.

Marketing messages (promotions, win-back, news) require your clients' prior consent under French and EU law (CPCE art. L34-5, ePrivacy, GDPR), unless a documented exception applies to existing customers for similar services. Chatity records consent evidence and opt-outs (including the STOP keyword) and will only send marketing messages to eligible recipients when you have enabled marketing in your settings. You remain solely responsible for the lawfulness of each campaign, and you warrant that you have obtained all required consents for any contact list you upload or ask us to message.

9. Artificial intelligence features

Chatity uses large language models and speech technologies to understand messages and calls, generate replies, suggest appointment times and perform actions you configure (create, confirm, reschedule or cancel bookings). Your prompts, knowledge base and the generated replies ("Inputs" and "Outputs") belong to you to the extent protectable by law; Chatity uses them only to provide the service.

AI output can be inaccurate, incomplete or inappropriate. You must configure the assistant responsibly, review its behaviour, keep your knowledge base accurate and intervene when needed (takeover mode). AI output is not medical, legal or financial advice. Chatity is not liable for decisions taken by you or your clients on the basis of AI output.

The assistant is instructed not to request or record health or medical information in the standard mode (see section 10).

10. AI phone receptionist — additional obligations

When you activate the AI phone receptionist, inbound and outbound calls are answered by an automated AI system, recorded, transcribed and summarised so that you can review them. Chatity's default greeting informs the caller that they are speaking with an AI assistant and that the call is recorded; you must not remove or disable this disclosure (EU AI Act transparency obligations and CNIL rules on call recording).

You must comply with the laws applicable to automated calls and messages in the countries you call, including any required disclosures and consents, and you must configure a transfer number so that callers can reach a human.

If the receptionist sends WhatsApp or SMS messages after a call (confirmations, business card), such messages are service messages related to the caller's request; promotional content requires consent as per section 8.

11. Sensitive and health data

The standard service is not designed for special categories of personal data (Article 9 GDPR) such as health, medical conditions, allergies, pregnancy or medication, nor for payment-card numbers. Do not enter such data in client notes or ask the AI to collect it. A dedicated health-data mode for permanent make-up, aesthetic or medical practices may be offered under separate terms and safeguards; until it is enabled for your account, Chatity has no liability for health data entered in breach of this section.

12. Content, licence and feedback

You retain all rights to the content you upload (texts, photos, logos, knowledge base, client data). You grant Chatity a non-exclusive, worldwide, royalty-free licence to host, process, display and transmit that content solely to provide, secure and improve the service for you, for the duration of your account. Chatity does not use your clients' personal data for its own marketing.

You warrant that you own or have the rights to the content you upload and that it does not infringe third-party rights. Chatity may remove content that violates these Terms or the law.

If you send us suggestions or feedback, we may use them freely without obligation or compensation. Beta or preview features are provided "as is", may change or be withdrawn at any time and may be subject to additional terms.

13. Mini-sites and hosted content

Chatity hosts public mini-sites and widgets on behalf of businesses. The business is the publisher of its mini-site content and is responsible for its legality (including mandatory legal information for its own activity). Chatity acts as a hosting provider within the meaning of French law (LCEN art. 6) and the Digital Services Act. Notices of allegedly illegal content may be sent to legal@chatity.io with the URL, the reasons and your contact details; we will act promptly on valid notices.

14. Third-party services

Messaging channels, telephony, payments and other integrations are provided by third parties (e.g. Meta/WhatsApp, Green API, Zernio, Twilio, ElevenLabs, Stripe, Planity). Their availability, pricing and terms are outside our control; by connecting them you accept their terms. Chatity is not responsible for outages or changes imposed by those providers, but will use reasonable efforts to adapt the service.

15. Availability, support, warranty

We aim for high availability but do not guarantee uninterrupted or error-free operation. Maintenance may be performed with reasonable notice where possible. Support is provided by email and in-app chat.

To the extent permitted by law, the service is provided "as is" and we disclaim implied warranties of fitness for a particular purpose or results (for example a given number of bookings).

16. Liability

Chatity's total liability to a business for all claims arising out of these Terms in any 12-month period is limited to the fees paid by that business to Chatity during that period. Chatity is not liable for indirect damages such as loss of business, revenue, data or reputation, nor for any act or omission of a business towards its End Clients.

Nothing in these Terms excludes or limits liability that cannot be limited under applicable law, including liability for gross negligence or wilful misconduct, personal injury, or the mandatory rights of consumers.

Chatity is not liable to End Clients for the services, acts or omissions of a business. Any claim by an End Client regarding an appointment or service must be addressed to the business concerned.

17. Indemnification

You will indemnify Chatity against third-party claims arising from your breach of these Terms or of applicable law, including unlawful marketing communications, infringing content or unlawful processing of your clients' data.

18. Suspension, termination and data after termination

You may delete your account at any time from Settings. We may suspend or terminate an account for breach of these Terms, non-payment, fraud, abuse or legal requirements, with notice where reasonably possible.

Before deletion you can export your bookings and client data. Upon account deletion we delete the account and the client data processed on your behalf, disconnect integrations and invalidate tokens; invoices and accounting records are anonymised and retained for the statutory period. Retention rules you configured (e.g. conversation retention) are executed automatically during the life of the account. Sections 7, 12, 16, 17 and 20 survive termination.

19. Changes to these Terms

We may update these Terms to reflect changes in the service, in law or in our practices. Material changes are notified by email or in the dashboard at least 30 days before they take effect; continued use after that date constitutes acceptance. If you disagree, you may terminate your account before the effective date.

20. Governing law, mediation and jurisdiction

These Terms are governed by French law. Any dispute will be submitted to the competent courts of Nice, France, without prejudice to mandatory rules granting jurisdiction to another court. Disputes may also be brought before the courts of the EU Member State where a consumer End Client resides where applicable law so requires.

Consumer mediation: where a user qualifies as a consumer under French law, they may, after contacting us, refer the dispute free of charge to a consumer mediator (médiateur de la consommation) or use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Details of the appointed mediator are provided on request at legal@chatity.io.
